1. Acceptance of Terms
By accessing or using the KamoCRM platform and website at kamocrm.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not access or use the Service. We reserve the right to refuse service to anyone for any reason at any time.
2. Description of Service
KamoCRM is an all-in-one business operating system that provides CRM and pipeline management, video conferencing, third-party phone integration (via RingCentral), email integration, real-time messaging, document collaboration, knowledge management, AI-powered intelligence, and related business tools through a unified platform.
The Service is provided as a cloud-hosted platform accessible via web browser. Features and functionality vary based on your subscription plan. All plans require a custom domain to be associated with the account and include custom branding at no additional cost. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice to affected users.
3. Account Registration
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for updating it promptly if it changes.
Each individual may maintain only one user account. Organizational accounts may have multiple users, each with their own individual credentials. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
You must notify us immediately through our contact form if you suspect any unauthorized access to or use of your account. KamoCRM Inc. is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to: (a) violate any applicable law, regulation, or third-party rights; (b) transmit any malicious code, viruses, or harmful content; (c) attempt to gain unauthorized access to any part of the Service or its infrastructure; (d) interfere with or disrupt the integrity or performance of the Service; (e) harvest, scrape, or collect information about other users without their consent; (f) impersonate any person or entity or misrepresent your affiliation; or (g) use the Service for any purpose that is fraudulent, deceptive, or harmful.
We reserve the right to investigate and take appropriate action against any user who violates these Terms, including suspension or termination of their account without notice.
5. Intellectual Property
The KamoCRM platform, including its software, design, features, documentation, and all related intellectual property, is owned by KamoCRM Inc. and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
The KamoCRM name, logo, and all related branding are trademarks of KamoCRM Inc. You may not use these trademarks without our prior written consent, except as expressly permitted under our white-label program for authorized organizations.
6. User Content
You retain full ownership of all data, content, and materials that you upload, create, or store on the Service ("User Content"). KamoCRM Inc. does not claim any ownership rights over your User Content.
By using the Service, you grant KamoCRM Inc. a limited, non-exclusive license to host, store, process, display, and transmit your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or close your account.
You are solely responsible for your User Content and for ensuring that it does not violate any applicable laws or third-party rights. KamoCRM Inc. does not monitor or endorse User Content but reserves the right to remove content that violates these Terms.
7. Payment Terms
KamoCRM offers a Free plan and paid subscription plans (Starter, Business, and Enterprise). The Free plan provides access to core features for a single user with 3 GB of storage, requires no credit card, and has no expiration date. Paid plans unlock additional features, higher usage limits, more users, and premium support as described on our pricing page.
All paid plans include a 14-day free trial with full access to plan features and no credit card required. At the end of the trial, you may subscribe or your account will revert to the Free plan with your data preserved.
For paid subscriptions, billing occurs on a monthly or annual basis as selected during checkout. Annual billing provides approximately 17% savings compared to monthly billing. All fees are quoted in United States Dollars (USD). We accept payment via Visa, Mastercard, American Express, and Discover. Enterprise customers may arrange invoice billing with NET-30 payment terms subject to credit approval. You authorize us to charge your designated payment method for all applicable fees. Your subscription will automatically renew at the end of each billing cycle unless cancelled before the renewal date.
Annual subscriptions are protected by a 30-day money-back guarantee from the date of initial purchase or renewal. Refund requests submitted after 30 days are not eligible. Monthly subscriptions may be cancelled at any time, with access continuing through the end of the current billing period. No partial refunds are issued for monthly plans. Refunds are processed to the original payment method within 5–10 business days.
Upgrades take effect immediately. When upgrading mid-cycle, you are charged a prorated amount for the remainder of the current billing period at the new plan rate. Downgrades take effect at the start of the next billing cycle. When downgrading, features exclusive to the higher plan become unavailable and any data exceeding the new plan's limits is preserved in read-only mode for 30 days to allow for export or reduction. Adding or removing users mid-cycle is prorated.
KamoCRM Inc. reserves the right to modify pricing at any time. Existing subscribers will receive at least 30 days' written notice before any price increase takes effect. Annual subscribers are protected at their current rate for the remainder of their prepaid term. If you do not agree to a price change, you may cancel your subscription before the new pricing takes effect.
8. Service Availability
We strive to maintain high availability for the Service as measured on a monthly basis excluding scheduled maintenance windows. The Business plan includes a 99.5% uptime commitment and the Enterprise plan includes a 99.9% uptime SLA with service credits for qualifying downtime. Free and Starter plans are provided on a commercially reasonable best-effort basis without formal uptime commitments. While we make every effort to ensure continuous availability, the Service is provided on an "as-is" basis and we do not guarantee uninterrupted access.
Scheduled maintenance will be performed during low-traffic periods and announced in advance through the platform and email notifications. Emergency maintenance may be performed without advance notice when necessary to address critical security or stability issues.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the data practices described in our Privacy Policy.

10. Termination
You may terminate your account at any time through the account settings in the platform. Upon termination, your right to use the Service ceases immediately.
We may terminate or suspend your account at any time if you violate these Terms, engage in conduct that is harmful to other users or the Service, or for any other reason with reasonable notice. In cases of severe violations, we may terminate access immediately without notice.
Upon termination, your account enters a 30-day read-only period during which you may export your data in standard formats (CSV, JSON, PDF). We will send reminder notifications 7 days and 1 day before permanent deletion. After this 30-day period, all user data is permanently and irreversibly deleted from our systems, including backups, in accordance with our data retention policies and applicable data protection regulations. Enterprise customers may negotiate extended data retention periods as part of their service agreement. It is your responsibility to export any data you wish to retain before the 30-day window expires.
11. Limitation of Liability
To the maximum extent permitted by applicable law, KamoCRM Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.
Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid to KamoCRM Inc. during the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless KamoCRM Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) your User Content.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of laws provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of the applicable jurisdiction.
14. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue formal legal remedies as described in Section 13.
For any disputes that proceed to formal resolution, each party agrees to waive the right to a jury trial. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice through the Service, by email, or by other appropriate means at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may terminate your account as described in Section 10.
